Section 40
Salary if suspended

(1) If an employee is suspended in connection with government work or as a result of action taken by the Government of Nepal, he shall receive only half of his salary during the period of such suspension. But if the allegations are not proved and he is cleared, if he has received half of his salary during the period of suspension, then he will be deducted and if he has not received, he will get full salary (including if there is an increase in salary) and festival expenses. If he is found guilty, he will not get the remaining salary allowance from the date of suspension.
(2) If an employee is suspended for any reason other than the reason mentioned in sub-section (1), he shall not receive salary for the period of such suspension.
