Section 17
Pensions and Gratuities
(1) If a person who is in a constitutional post or in the service of the Government of Nepal or who has retired from such service is appointed to the post of Attorney General and retires from service, if the period of service completed by him and the period of service in the post of Attorney General is twenty years or more, he shall pay his monthly Two-thirds of the salary or a monthly pension calculated as follows:- Total years of service X monthly salary / 50 Explanation: For the purpose of this section, "period of service in government service" means the period of service appointed in any post eligible for pension from the Government of Nepal. will indicate.
(1A) Notwithstanding anything written in sub-section (1), if a person who has completed ten years of service in the position of Attorney General retires from service, he shall receive a monthly pension of two-thirds of his monthly salary.
(2) The attorney general who retires without completing the service period for which he is entitled to pension under subsection (1) or (1a) will be given a lump sum gratuity which is calculated by multiplying the total number of years he has served by the number of one and a half months of salary earned at the time of retirement.
(3) If a person who has received gratuity in a constitutional position or for serving the Government of Nepal is appointed to the post of Attorney General, the entire amount of gratuity received by him within one year of his appointment shall be added for the purpose of pension.
(4) The amount of gratuity to be received by the Attorney General in accordance with this section shall not exceed an amount equal to his twelve months' salary.
(5) When the salary of the Attorney General is increased, two-thirds of the increase in the salary scale shall be added to the pension amount of the Attorney General who is receiving pension.
(6) If a person who is receiving pension in a constitutional position or for serving the Government of Nepal is appointed to the position of Attorney General and can also receive pension in accordance with this Act, the pension he is receiving before and any of the pension that he will receive in accordance with this ActOne can choose.
(7) For the purpose of sub-section (1A), when calculating the period of service, half of the total period worked in a constitutional position or in a government service position or in both positions shall be counted.
