(1) The Government of Nepal shall be the plaintiff in the case of an offense punishable under section 5 and such case shall be filed in the court by police of inspector rank at least.

(2) If there is reasonable cause to suspect that he has committed or is attempting to commit a crime punishable under Section 5, any police officer shall arrest such person without a warrant and present him to his officer, at least to the rank of inspector, for action.
