Rule 12
May order conciliation on application of parties
(1) If the parties to a case filed before the case hearing body want to resolve the case through the conciliation process, they can submit an application to the case hearing body at any time in the format as per Schedule-5.
(2) If the application as per sub-rule (1) is given by only one party to the case, the body looking into the case shall seek the consent of the other party on whether or not they want to go to the conciliation process.
(3) On the basis of the application received as per sub-rule (1) or the agreement of the parties as per sub-rule (2), if it appears that both parties want to resolve the case through the process of conciliation, the following officer may issue an order as per Schedule-6 to resolve such case through the process of conciliation:-
(a) the Registrar in the case of the Supreme Court and the High Court,
(b) Shrestedar in case of District Court,
(c) In the case of an agency looking into other cases, the head of that agency.
(4) Regardless of what is written in sub-rule (3), in the case of a case in the list of appearance, the order to resolve it through the process of conciliation shall be from the bench of the concerned body.
