Section 8A
Restriction on recruitment

(1) No position in the health service shall be filled by any other means except as provided in this Act.
(2) If a position in the health service becomes vacant in any way, the relevant body shall inform the Public Service Commission within one month of the vacancy. Officials who do not give notice within that period will be subject to departmental action.
(3) If written in accordance with sub-section (2), the position that has become vacant up to that period and also the position that will become vacant due to retirement and promotion within the current financial year can be requested.
(4) Other provisions related to the demand for filling the post shall be as prescribed.
(5) In the case of employees working in ministries, departments, offices located in the center and valleys, salaries should not be paid without passing the salary report from the relevant treasury and accounting controller office in the case of civil library and district office employees.
(6) If someone appoints an employee contrary to sub-section (1) or if it is found that the salary has been paid without passing the salary report as per sub-section (5), the amount of salary, allowance and other benefits received by such employee shall be recovered from the appointing and salary-disbursing officer as government dues.
