Section 2
Definition Definition
In this Act, unless the context or the context otherwise requires,–
(a) "Chairman" means the Chairman of the Commission.
(b) "Commission" means the Commission of Inquiry into Disappeared Persons or the Truth and Reconciliation Commission established under Section 3.
(c) "Complaint" means a petition.
(d) "Prescribed" or "as prescribed" means prescribed or prescribed in the rules made under this Act.
(e) "Compensation" means the compensation, facility or concession provided to the victim as per section 23.
(f) "Family" means the victim's husband, wife, son, daughter, father, mother, mother-in-law, father-in-law, grandfather, grandson, granddaughter or brother or sister of the victim.
(g) "Perpetrator" means a person involved in a crime related to a serious violation of human rights during an armed conflict and the term also refers to a person who orders the commission of such a crime.
(h) "Victim" means a person who has died or suffered physical, mental, sexual or economic harm or been imprisoned as a result of serious violations of human rights during an armed conflict, and a member of his family and the term includes any person who has suffered as a result of serious violations of human rights , refers to the community that has been seriously adversely affected socially or communally.
(i) "Ministry" means Government of Nepal, Ministry of Peace and Reconstruction (j) "serious violation of human rights" means any of the following acts committed against unarmed persons or groups of people during an armed conflict:-
(1) Murder,
(2) Kidnapping and body hostages,
(3) Disappearance of persons,
(4) maiming or maiming,
(5) physical or mental torture,
(6) Rape and sexual violence,
(7) Looting, seizing, vandalizing or arson of private or public property,
(8) Forcible eviction from the property or any other form of displacement, or
(9) contrary to international human rights or humanitarian lawAny kind of inhuman acts or other crimes against humanity committed.
(k) "disappearing person" means any of the following acts:-
(1) A person who has been authorized to arrest, investigate or enforce the law according to the law, or a person who has been arrested, detained or taken into custody by security personnel in any other way, shall not appear before the officer who hears the case, but the period to be brought before the officer who hears the case in accordance with the prevailing law Even after it has passed, not allowing the interested parties to meet or not giving them information about what, how and in what condition they have been kept,
(2) Depriving any person of his personal liberty by arresting or abducting or detaining him in custody or in any other manner in the name of any organization or organized or unorganized group during armed conflict.
(l) "Comprehensive Peace Agreement" means the agreement concluded between the Government of Nepal and the then Communist Party of Nepal (Maoist) on November 5, 2063.
(d) "Secretary" means the Secretary of the Commission (d) "Member" means a member of the Commission and the term also refers to the Chairman.
(n) "Armed conflict" means the armed conflict between the state party and the then Communist Party of Nepal (Maoist) from February 1, 2052 to November 5, 2063.
