: The terms defined in the Nepal Petroleum Act, 2040 shall have the same meaning for the purpose of this Agreement. In this Agreement, unless the subject or subject indicates otherwise, -
(a) "Investigation period" means the primary investigation period as mentioned in paragraph 2 and the additional period.
(b) "exploration work" means all necessary work as mentioned in the annual program according to section 13 to 15 or the feasibility program according to section 17 for exploring petroleum in accordance with the petroleum agreement and for evaluating the commercial development of the discovered petroleum.
(c) "Unaffiliated Party" means an independent person who has no relationship with any party under the Petroleum Agreement.
(d) "Production Permit" means the production permit granted under Section 24.
(e) "Production period" means the period specified in section 23.
(f) "Production work" means all necessary work of refining, transporting, storing and selling petroleum products.
(g) "Production area" shall mean the area specified in the production permit and for the purposes of sections 5, 6 and 8, the term shall also mean the area specified in such application in case the application for production permit is pending.
(h) "Act" means the Nepal Petroleum Act 2040.
(i) "Katkendar" means a person appointed (hired) by the contractor for petroleum work.
(j) "Contract Year" means an unbroken period of twelve (12) months in the Gregorian calendar commencing on the applicable date or the annual date of such date.
(k) "Treaty area" means the area which is being abandoned and decreasing as mentioned in the appendix as per paragraphs 2 and 3.
(l) "Programme" means the initial annual feasibility or development program as per section 13, 14, 17 and 18.
(d) “Contractor's share” means petroleum produced in the contract area as determined under section 34;The portion of petroleum to be received by the contractor should be mentioned.
(l) “Dollars” shall mean United States Dollars.
(n) “Regulations” means the Petroleum Regulations, 2041.
(t) "Petroleum Expenses" shall mean the expenses incurred by the Contractor in the operation of Petroleum Works in accordance with this Agreement as defined in paragraph 7.
(h) “Budget” means the estimated cost of each activity included in the program.
(d) "Year (calendar year)" means an unbroken period of twelve (12) months commencing on the 1st day of January and ending on the 31st day of December of the same year according to the Gregorian calendar.
(d) "Development work" means all necessary work as mentioned in the development program as per Section 18 for the purpose of developing the site commercially.
(N) "Sale distribution" means sale, exchange or transfer of petroleum with or without price.
(c) "Commercial production day" means the day on which the contractor sells and distributes petroleum produced in commercial quantities from the production area for the first time in accordance with this agreement.
(f) "Royalty" means the amount of petroleum to be kept by the Government of Nepal in accordance with Section 13 of the Act.
(b) "Applicable Date" means the date on which the Government of Nepal and the contractor signed the Petroleum Agreement.
(B) "Field" means an area with one or more petroleum deposits associated with or associated with a geological structure or isostatic condition and capable of commercially producing petroleum.
(m) "Part of the Government of Nepal" means the part of the petroleum of the Government of Nepal out of the petroleum produced in the contract area as determined under section 34.
(y) “Calendar Quarter” means a continuous period of three (3) months commencing on January 1, April 1, July 1 or October 1 and ending on March 31, June 30 September 30 or December 31 according to the Gregorian calendar; should
