In this Act, unless the context or the context otherwise requires,–
(a) "Court" means the Constitutional Bench of the Supreme Court as per clause (1) of Article 137 of the Constitution.
(b) "Minority community" shall mean the ethnic, linguistic and religious groups specified by the Government of Nepal under Clause (a) of Clause (1) of Article 306 of the Constitution based on the national census conducted immediately before the election.
(c) "Commission" means the Election Commission under Article 245 of the Constitution.
(d) "Candidate" means a person who has been nominated as a member of the Provincial Assembly in accordance with Section 18 and the term also refers to a person whose name is included in the closed list of candidates in accordance with Section 28.
(e) "Closed list of candidates" means the closed list submitted by the party to the Commission in accordance with section 28 for the purpose of nomination in the elections held under the proportional election system.
(f) "Prescribed" or "as prescribed" means prescribed or prescribed in the rules made under this Act or in the order issued by the Commission under Section 76.
(g) "Party" shall mean a political party registered with the Commission for the purpose of election and the term also refers to a group of parties participating in the election jointly by taking a single election symbol.
(h) "Election" shall mean the election of a member of the Provincial Assembly and the term also refers to the by-election held when the position of the elected member is vacant according to the first-come, first-served election system.
(i) "Electoral Officer" means the Chief Electoral Officer and the Electoral Officer appointed by the Commission in accordance with Section 8 and the term also refers to the Assistant Electoral Officer.
(j) "Constituency" means the constituency determined by the Constituency Determining Commission in accordance with the federal law for elections held under the first-come, first-served electoral system.
(k) "Election representative" means the representative appointed under section 63;Achan should be considered representative.
(l) "First-come, first-served election system" means the election system as per section 4.
(D) "Backward Area" shall mean the backward area under each province designated by the Government of Nepal by publishing a notice in the Nepal Gazette.
(l) "Provincial Assembly" means the Provincial Assembly formed in accordance with Article 176 of the Constitution.
(n) "Voter" means a person whose name is included in the final electoral roll for an election in accordance with federal law.
(s) "Ballot" shall mean a ballot paper arranged for voting in an election and the term shall also refer to a ballot paper used in such electronic equipment or a digital ballot attached to such equipment in case voting is done by electronic equipment.
(h) "Ballot box" shall mean the ballot box arranged by the Commission for keeping the ballot paper marked with the vote and the term also refers to the electronic device which records the vote signal of the vote cast in the case of voting by electronic device.
(d) "Polling Officer" shall mean a Polling Officer appointed under Section 11 and the term also includes an Assistant Polling Officer.
(d) "Member" means a member of the Provincial Assembly.
(N) "Proportional Election System" means the election system as per section 5.
(p) "Constitution" means the Constitution of Nepal.
