Section 2
Definition
: In this Act, unless the subject or context requires otherwise,-
(a) "Multi Modal Transportation" means the act of transporting goods on the basis of a multi modal transportation contract. (b) "Multi-modal transport contract" means the contract between the sender and the multi-modal transport operator, where the multi-modal transport operator receives the goods from the sender in any one place in the state of Nepal and transfers the goods to a designated place outside the state of Nepal using two or more different means of transport.
(c) "Multimodal transport operator" means a company licensed under Section 4 to operate multimodal transport services.
(d) "Department" means Ministry of Industry, Commerce and Supply, Department of Commerce (e) "Consignor" means a person who enters into a multimodal transport agreement with a multimodal transport operator regarding the transfer of goods.
(f) "Consignee" means a person who has received the right to receive the goods from the multimodal transport operator or his official agent or representative according to the multimodal transport contract.
(G) "Multimodal shipping document" means a document certifying the multimodal shipping contract that the multimodal shipping operator has accepted the responsibility of transporting and handing over such goods after accepting the goods from the sender in accordance with the multimodal shipping contract.
(h) "Negotiable multimodal transport document" means a multimodal transport document issued in the name of the directed person or carrier or issued in such a way that the directed person or carrier can transfer it to another person with or without a seat.
(i) "Non-negotiable multimodal transport document" means a multimodal waybill issued with the name of the consignee mentioned.
(j) “Transfer” means multipleAccording to the contract of carriage, the act of delivering the goods to any person specified in accordance with the written permission of the consignee or the consignor should be remembered.
(k) "undertaken" means the task of receiving the goods from the consignor by the multimodal transport operator in order to hand over the goods transported to the consignee in accordance with the multimodal transport contract.
(l) "Goods" shall mean goods transported in containers or packed or not, pallets or goods of a similar nature and live animals.
(d) “SDR (Special Drawing Rights)” shall mean SDR as defined by the International Monetary Fund from time to time.
(d) "Darpeeth" means the act of signing by the consignee on the front or back side of the multimodal waybill in order to transfer the ownership of the goods mentioned in the multimodal waybill to the designated person according to the multimodal waybill.
(n) "Prescribed" or "as prescribed" means prescribed or prescribed in the rules made under this Act.
