Rule 40
Conducting re-voting
(1) During the counting of votes in accordance with rule 39, if any candidate fails to obtain a majority of the total votes of the electorate according to sub-section (2) of section 55 of the Act, the election officer shall appoint the two candidates who received the highest number of votes in accordance with section 56 of the Act. The notice of the appointment of another date for voting among the candidates shall be immediately published in his office. (2) After voting in accordance with sub-rule (1) and counting of votes in accordance with rule 39, if any candidate receives more than fifty percent of the total votes in accordance with sub-section (2) of section 56 of the Act. The Election Officer shall declare that such candidate has been elected. (3) If no candidate receives more than fifty percent of the total votes during the counting of votes as per Sub-rule (2), the Election Officer shall set another date for re-voting between the two candidates as per Sub-rule (1). The notice shall be published immediately in his office. (4) During the counting of the votes in accordance with sub-rule (3), the election officer shall declare the candidate who has received more votes than the total number of votes cast in accordance with sub-section (4) of section 56 of the Act. (5) Sub-rule According to (1) or (3), when the Election Officer sets another date for re-voting, if the Commission has given any instructions in this regard, it should be considered and fixed so that the voting will be held as soon as possible.
