Rule 126
Considerations and decisions on appeals
: (1) If the appeal made by an armed police officer against the order of departmental punishment above him is not reached in accordance with Rule 125, the officer hearing the appeal may file such an appeal.
(2) If there is a bench according to sub-rule (1), if an appeal is filed in the manner mentioned in the bench order, such appeal should be registered.
(3) In an appeal registered as per sub-rules (1) and (2), the officer hearing the appeal shall consider the following matters:-
(a) Whether the truth of the matters relied upon in the departmental punishment order has been proved or not? (B) Are the things that have been proven sufficient to warrant a departmental punishment or not? (c) What is the appropriate or excessive departmental punishment? (4) After consideration in accordance with sub-rule (3), the officer hearing the appeal may give a final order confirming or canceling the sentence given to the appellant or reducing such sentence.
