Section 38
Restrictions on petroleum expenditure
: Petroleum expenditure should be within the following limits:
(a) The cost of the work performed directly by the contractor shall not exceed the actual cost and such cost shall not exceed the competitive rate charged by an unrelated party for the same work.
(b) The overhead expenses incurred by the contractor within Nepal shall not exceed the actual expenses incurred by him.
(c) The overhead expenses incurred by the contractor (and the contractor's affiliates) outside Nepal shall not exceed the annual amount approved in advance by the Government of Nepal. Such amount shall in no case exceed the following limits:
(Except for overhead expenses incurred outside Nepal) Extent of annual petroleum expenses Extent of overhead expenses up to $10,00,000 5 percent from $10,00,000 to $50,000,000 3 percent from $50,00,000 to $2,00,00,000 1 0.25% above $200,000,000 (d) The expenses incurred by the contractor for goods and services of contractors shall not exceed the actual expenses incurred by the contractor and such expenses shall not exceed the competitive rate charged by an unrelated party at the time of contracting for such goods and services.
(e) The expenses incurred in acquiring or restoring the goods, equipment and other materials and the construction expenses of the facilities shall not exceed the actual expenses and the construction expenses of such goods and facilities, the restored and competitive price and such expenses shall include transportation, insurance and connection expenses as required. . But it will not include any markup or any commission etc. given to the contractor or any of its affiliated companies. After the production permit has been granted, the capital goods acquired for the development of the production sector should not be given back without the prior approval of the department.
