: An establishment producing or distributing any goods or services shall not merge, alone or alone with other establishments producing or distributing goods or services of a similar nature with the aim of maintaining a monopoly or maintaining a controlled business practice in the market. It is not possible to purchase fifty percent or more shares of such an establishment with a subsidiary establishment or take over the business of such an establishment. Explanation: For the purposes of this section, when a person or establishment producing or distributing goods or services of the same nature merges, merges, buys shares or takes over, the production or distribution of more than forty percent of the total production or distribution of such goods or services within the State of Nepal. If it happens, the establishment will be considered to have merged, combined or taken over for the purpose of controlling competition.
