Section 12
Waste management site
(1) The local level may designate a waste management site (sanitary landfill site) subject to the existing laws related to the environment for the management and permanent disposal of waste collected within its area.
(2) According to sub-section (1), if there is no land at the local level to designate a waste management site, or if there is land, it is not suitable for designating a waste management site, then a suitable land can be rented or purchased and designated as a management site.
(3) When the waste management site is designated in accordance with this section, the development and operation of the waste management site can be done even on the private land of the private sector subject to section 16.
(4) If there is a lack of land to designate a waste management site according to sub-section (1) or (2), the local level may request the Ministry to select a suitable site and provide it.
(5) If there is a request to provide a waste management site according to sub-section (4), the Ministry will acquire such land and provide it to the local level in accordance with the prevailing law.
(6) If two or more local levels find the same waste management site appropriate, the Ministry may designate a waste management site with the written consent and condition of the respective local levels in coordination between such local levels.
(7) The local level should carry out the operations related to the operation and post-closure management of the waste management site in accordance with the prescribed environmental standards.
(8) In accordance with sub-section (7) after the closure, while doing management related work, the initial environmental test and environmental impact assessment report of the waste management site should be done in accordance with the suggestions recommended.
(9) The local level can declare the waste management site area as an environmentally sensitive area if necessary.
(10) Prohibition of unauthorized entry of animals, birds, animals and human beings in the area as per sub-section (9), prohibiting stone, gravel and sand extraction, as well as other necessary instructions and guidelines for environmental protection and proper management of such area may be issued and implemented.
