Section 38
Offense
If anyone commits any of the following acts, he shall be deemed to have committed an offense under this Act:-
(a) Disposing of garbage outside the time and place specified by the local level,
(b) Unauthorized use of waste stored in containers or waste collection centres,
(c) vandalizing, damaging, removing from the place where the container is kept at the waste disposal center or causing any damage to the collection centre, (d) Doing waste management without obtaining permission in accordance with this Act,
(e) Violating the conditions mentioned in the permit granted for waste management in accordance with this Act,
(f) throwing, keeping or depositing any noxious substance in a waste collection centre, container or waste dump,
(g) Placing, throwing or piling the garbage of houses, compounds and premises on the road or other public places,
(h) Contaminated water (leachate) or sewage from sewage and pollutes the house or land of another person,
(i) Park any type of vehicle or refuse to remove the parked vehicle at the time specified by the local level for cleaning and collecting garbage on the road or other public place or during cleaning, (j) Keeping, throwing, piling up or expelling any kind of harmful garbage on the road or other public places in such a way as to have an adverse effect on public health except in the places designated by the local level,
(k) Willfully dumping, keeping or disposing of chemical waste, industrial waste, health institution waste or harmful waste, (l) Industrial establishment or health institution to throw, keep or dispose of harmful waste from the industry or health institution, (d) Creating obstacles in waste collection, transportation and waste management (d) Obstruction, closure, cordoning or waste management at waste collection, transportation and final disposal sites.Strike in bonded labor,
(b) Production and sale and distribution of any item which has been banned by the Government of Nepal by publishing a notice in the Nepal Gazette as an item that produces excessive amounts of waste,
(p) import of chemical pesticides contrary to section 44 or failure to fulfill responsibility for destruction of expired (expired) drugs,
(h) without separating the waste at the source and disposing of it by mixing it with the waste contrary to section 6,
(d) Keeping, throwing or piling up dead or killed animals and birds and their carcasses, feathers, bones and slaughtered fish etc. in public places, streets, streets, squares.
