(1) After publication of the promotion list in accordance with Rule 72, for the purpose of promotion complaint, the candidate who is recommended for promotion shall be placed on the waiting list without promotion appointment for thirty-five days from the date of publication of the list. If there is no appeal on the above promotion recommendation, the appointment shall be made in such a way that the seniority of the promoted category is maintained from the thirty-sixth day after the date of publication of the list (the day after the expiry of the appeal deadline).
(2) If there is a complaint against the promotion recommendation as per Section 38 of the Act, the seniority date shall be maintained and the appointment shall be made as follows:-
(a) If there is a decision to revise the promotion recommendation according to subsection (2) of section 38 of the Act, from the date of publication of the revised list accordingly,
(b) from the thirty-sixth day from the date of publication of the list of employees recommended for promotion for the first time, if the complaint is dismissed or if the previous recommendation for promotion is upheld, and
(c) In case of a promotion case in the court, the promotion is revoked and the promotion committee makes a decision regarding the promotion, from the date of the last promotion committee decision.
(3) According to sub-rule (1), within thirty-five days from the date of publication of the promotion list, the promotion committee may not include the list of such employees in the promotion recommendation if they are to be promoted in accordance with section 39 of the Act.
