Rule 39
Special provisions regarding promotion

(1) Notwithstanding anything written elsewhere in this regulation, the commission will recommend that a teacher who is permanently appointed to the post of a teacher at any level and who will receive a pension from the same level and who will be compulsorily retired one month in advance to be promoted to a higher level of the same level.
(2) A teacher retiring according to sub-rule (1) should submit an application to the relevant district education office six months before the date of retirement with the necessary documents attached.
(2A) If it is found that the applicant teacher can be promoted while selecting the documents with the application received according to sub-rule (2), the district education officer shall send the application to the Commission at least ninety days before the retirement of such teacher.
(2B) When selecting the documents with the application received as per sub-rule (2A), if it is found appropriate to promote the applicant teacher, the commission shall recommend to the concerned district education office to promote such teacher as per sub-rule (1).
(2c) If recommended by the commission according to sub-rule (2b), the district education officer shall promote the petitioner to one level above the same level one month before retirement.
(3) Promotion as per sub-rule (1) shall automatically be deemed to have created a special post and after such teacher retires from service, the promoted post shall automatically be canceled and the old post shall remain.
(4) Even if no teacher has submitted an application for promotion according to this rule, the teacher's library shall determine the pension of the teacher recommended for promotion by the commission on the basis of the documents related to such teacher.
