(2) Notwithstanding anything written in sub-rule (1), if the department finds it necessary to declare a bird flu-affected area including the area more than three kilometers from the place where the bird flu sample was taken for bird flu control due to the fact that the bird flu has spread as an epidemic or is likely to spread during the risk analysis, the department Along with the risk analysis report, it can recommend to the ministry to declare the bird flu affected area, even the area of ​​more than three kilometers of the bird flu area.
(3) According to the recommendation received under sub-rule (1) or (2), if it is necessary to declare any place or area of ​​Nepal affected by bird flu as a bird flu affected area, the Government of Nepal may declare such place or area as a bird flu affected area for a specified period.
(4) After bird flu has been controlled in the bird flu affected area, if bird flu occurs in the same district or province and other districts bordering the related district or province, the perimeter of the bird flu affected area can be expanded according to sub-rule (3) based on the area where bird flu has occurred.
