Section 16
Things to be considered while punishing a child
:(1) While punishing a child, the following things shall also be considered:-- a) his best interest, b) seriousness of the offense and amount of guilt, c) his personal circumstances, Explanation: This section For the purpose, "personal circumstances" means the child's age, education, family status, social situation, type of offence, harm caused by the offense and purpose of the offence. d) compensation offered to the victim, e) remorse for the crime, f) desire to live a good and useful life. 2) When punishing children who have not reached the age of sixteen years, imprisonment should not be imposed except for heinous crimes, serious crimes or crimes committed in a serious manner. 17. Matters to be disclosed while determining the punishment According to this Act, the following matters shall be disclosed in the judgment or order while determining the punishment:--
(a) Cause of Punishment,
(b) In determining the penalty, the amount of the fine to be paid by the offender, the date on which the fine is to be paid, if it is allowed to be paid in installments, and the imprisonment that may be imposed for non-payment of the fine,
(c) In determining the sentence of imprisonment, the period of imprisonment, the date of imprisonment, the date of payment of imprisonment,
(d) Type of service, duration, time and punishment for non-service if there is an order to do community service,
(e) When determining the sentence to pay imprisonment in a correctional home or rehabilitation center, the period of stay in such home or center, the conditions to be followed and the punishment that may be imposed for violating such conditions,
(f) Whether or not the offender can be released on parole,
(g) If the imprisonment is suspended, for how long will it be suspended,
(h) If compensation is to be paid, the amount of compensation, the period to be paid, the manner and the penalty for non-payment,
(i) In case of suspension of the conditional sentence in the case of children in accordance with sub-section (5) of section 24, the punishment that may be imposed for violating such condition,
(h) Other necessary matters deemed appropriate by the court.
