Rule 42
Sick leave
(1) Employees will get twelve days sick leave every year. (2) Employees will receive full salary while on sick leave.
(3) If the employee becomes disabled and does not have enough accumulated sick leave, he can be given advance sick leave up to a maximum of twelve days.
(4) The employee will be entitled to sick leave even during the period of extraordinary leave and leave other than the sick leave as per sub-section (2) of section 59 of the Act.
(5) Employees requesting sick leave for a period of more than seven days shall submit an approved doctor's certificate. But if the authorizing officer believes that it was not normally possible to submit such a certificate, he may approve the said leave without the said certificate.
(6) Employees will be allowed to accumulate sick leave they have accrued. (7) If an employee is separated from service for any reason, he/she will be entitled to receive a lump sum amount due to his/her accrued sick leave at the rate of salary from the position he/she is entitled to.
(8) If the employee dies before receiving the accrued sick leave amount, the person as per sub-rule (2) of Rule 92 shall be entitled to receive the accrued sick leave amount as a lump sum.
(9) If there is insufficient sick leave and home leave to treat a major or serious illness, the employee may take additional sick leave up to forty-five days in advance by submitting a certificate from an approved doctor and deducting it from the sick leave and home leave he will receive later. Employees who have taken sick leave in advance will get full salary.
(10) If the leave taken according to sub-rule (9) is insufficient and additional leave needs to be taken, the Government of Nepal may take a maximum of one year of extraordinary leave during the entire service period by deducting it from the extraordinary leave received by the employee on the recommendation of the medical board appointed for civil service employees.
(11) In case of death of an employee who has taken sick leave in advance according to sub-rule (9), the sick leave so taken in advance will automatically be waived.
