(1) From the point of view of security, a special security cell will be arranged to keep prisoners of a sensitive nature within the prison with special security. (2) The prison administrator may keep the following prisoners in the cell as per sub-section (1):- (a) who has been ordered to be kept in a special security cell by the court or the Government of Nepal, (b) who has been arrested for escaping from the prison, (c) who has tried to escape by rioting inside the prison. , (d) commits larceny, harassment, sexual abuse or theft in the prison, (e) escapes from receiving medical treatment, appearing in court or being employed, (f) physically attacking other prisoners in the prison, ( g) Involved in criminal activities outside the prison while inside the prison. (3) According to this section, the period of detention of the prisoner in the special security cell shall be as determined by the prison administrator.
(4) Notwithstanding anything written in sub-section (3), the prisoner under clause (a) of sub-section (1) shall be kept in a special security cell for the period mentioned in such order.
(5) According to this section, the prison administrator shall give the information about the detention of the prisoner in the special security cell to the department and chief district officer in the case of 8 federal prisons and to the ministry, department and chief district officer of the provincial government in the case of provincial prisons.
(6) When giving information in accordance with sub-section (5), the reason why the prisoner should be kept in a special security cell and the period of time of being kept in that cell shall also be disclosed.
