Section 38
Formation of the Board
: (1) Formation of a Foreign Employment Promotion Board as follows for the purpose of promoting the foreign employment business and to make the business safe, orderly and dignified and to protect the rights and interests of foreign employment workers and foreign employment professionals. will be :
(a) Minister of Labor and Transport Arrangement - Minister of State - Chairman
(b) Minister of State for Labor and Transport - Assistant Minister - Vice President
(c) Member, National Planning Commission (Looking at concerned area) – Member
(d) Secretary, Ministry of Labor and Transport - Member (e) The Secretary or his designated representative of the First Class of Parliament, Ministry of Home Affairs – Member
(f) The Secretary or his designated representative of the First Class of Parliament, Ministry of Foreign Affairs – Member
(g) The Secretary or the first class representative appointed by him, Ministry of Finance - Member
(h) The Secretary or the RP First Class Representative appointed by him, Ministry of Law, Justice and Parliamentary Order – Member
(i) The Secretary or the first class representative appointed by the RP, Ministry of Women, Children and Social Welfare - Member
(j) Director General, Department – Member
(k) Representative (Same as First Class), Nepal Rastra Bank – Member
(l) Two members including one woman nominated by the Government of Nepal from among the foreign employment experts (D) Chairman of Foreign Employment Professionals Association and nominated by the same association (d) Two members, including one woman, nominated by the Government of Nepal from among the operators of skill-oriented and orientation training related to foreign employment. (n) At least MBBS from an approved health institution as per section 72. One person nominated by the Government of Nepal from among the passed doctors – member
(p) Four members, one representative each, nominated by the president of any four recognized trade union federations designated by the Government of Nepal or sent by such federations
(th) Representative, Federation of Nepal Industry and Commerce – Member
(d) Representative, Technical Education and Vocational Training Council – Member
(d) Executive Director – Member – Secretary
(2) According to sub-section (1), the term of office of the members nominated by the Government of Nepal shall be two years.
