Section 6
No Irregularity in the Tender
: (1) The bidder who submits such a bid in a public tender called by any body shall not cause irregularity in the tender by doing the following:
(a) By making an agreement not to file the bid of any bidder or to file the bid by only one bidder or directly or indirectly by all the bidders to file the bid mentioning the same price or other details,
(b) By informing each other of the information or other matters to be disclosed in the bid before submitting the bid,
(c) By filing a bid with mutual agreement so that the bid of one of the bidders can be accepted.
(2) Notwithstanding anything written elsewhere in this section, any exchange of information related to tender between any establishment or subsidiary establishment of such establishment shall not be deemed to be an irregularity as per sub-section (1).
