(1) The following employees shall not be eligible to be nominated for study or training:-
(a) who are not potential candidates for promotion in accordance with section 27 or whose promotion has been withheld in accordance with this Act,
(b) The official level employee who has been appointed and posted has not worked in remote areas for at least one year or in remote areas for two years and has been in a permanent position in the gazetted category of Nepal Health Service as per Civil Service Act, 2049 for at least one year before the commencement of Nepal Health Service Act, 2053. Very remote or not working in remote areas for two years.
(c) If the employee mentioned in section (b) has not worked in the field mentioned in the same section for the period mentioned in the same section, until such period he goes to work in that field and works, but when nominated for a training period of less than ninety days of strictly technical and specialist nature, as per this section Disqualification will not apply.
(2) Scholarships will not be provided by the Government of Nepal in case of studying without the prior approval of the Ministry.
