Rule 98
Procedure of Reconciliation
(1) Conciliation discussions and other necessary work can be done at the place designated by the court. In case the conciliator determines the location, the information about the location shall be given to the parties in writing.
(2) If ordered by the court for conciliation in accordance with this regulation, it shall be the duty of the parties to the case to appear before the conciliator on the specified date and time and to participate in the discussion related to the conciliation. If the conciliator does not come to appear on the specified date and time or does not participate in the discussion, the conciliator will inform the court about it and the court can take necessary action in this case.
(3) During the conciliation process, the parties of the case, their legal professionals, one person chosen by the parties of the case, experts related to the disputed subject as needed, and other experts, separately or collectively, as needed, to reach a conclusion acceptable to both parties by the mutual consent of the parties. will have to act as
(4) Subject to this regulation, the conciliator may, with the consent of the parties, determine the procedure for the conciliation.
(5) The conciliator may, with the consent of the parties, conduct separate interviews with the parties.
(6) The conciliator may also conduct the conciliation process by telephone, video conference or other appropriate means of communication with the consent of the parties.
(7) If a day has been fixed for appearing before the conciliator, even if he does not appear on that day, it shall not be deemed that the date has passed. If only one party is present on the day set by the court to appear before the conciliator or on the day set by the conciliator for discussion, or if both parties are not present, the conciliator shall send a report to the court stating that the conciliation process has not been conducted seven days after the date of their appearance has been paid. But if both parties are present within those seven days, the conciliator will have to proceed with the process of reconciliation.
