Rule 9
Issuance of term
(1) Except when the defendant is present with the indictment according to rule 8, in the case filed in the tribunal, when issuing the deadline in the name of the defendant, except for the deadline of the petition, the period of fifteen days shall be issued in the format as per schedule-1.
(2) When the deadline issued according to sub-rule (1) is served, the defendant or any member of his single-family family who has reached the age of majority must be served. If the defendant or any member of his single-family family who has reached the age is not found, or if he refuses to accept the deadline even if found, two local people shall be kept in Rohwar and posted the deadline on the door of the defendant's house or dera.
(3) If the employee who goes to meet the deadline issued according to sub-rule (1) does not find the home of the defendant, he shall report the same to any member or representative of the concerned local body or any two local people in Rohwar and keep such deadline in the office of the concerned village development committee in the case of the village development committee and to the municipality. In case, it shall be posted in the ward office of the ward where the defendant's house is located, and in the absence of such a ward office, it shall be posted in a public place, and after the deadline is postponed accordingly, such deadline shall be deemed to have been duly served. However, due to wrong address being written in the indictment or wrong address being mentioned by the tribunal, the time limit is not considered to have been duly served in the case where the time limit is extended to a place other than the place where the defendant or his house is camped. (4) When submitting a deadline issued in the name of an organized organization, the deadline must be submitted to the director or manager of such organized organization or the head person of such organization or the authorized officer of such organized organization. If such a person is not found or if he refuses to accept the deadline even if he is found, two local people will have to hang the deadline on the door of the office of such organized organization in the same manner.
(5) Notwithstanding anything contained in sub-rule (4), the term issued in the name of a body corporateIf mailed to the address of the registered office of such organized organization and sent by registered post or by telefax of such office or sent with a digital signature to the electronic address, such deadline shall be deemed to have been duly met.
(6) According to sub-rule (2), (3) or (4), the employee who is going to meet the deadline should complete the deadline within three days, excluding the travel deadline.
(7) If there is a report that the deadline has not been met according to sub-rule (2), (3), (4) or (5) or if the deadline issued by the tribunal is broadcast or published on electronic media such as radio, television, website of the tribunal or in any daily newspaper of national level If the Srestedar is confident that it is appropriate to meet the deadline by publication, the notification regarding such deadline can be broadcast or published accordingly. In the event that a notice is broadcast or published in this manner, it shall be deemed to have expired in accordance with this regulation after five days from the date of such notice being broadcast or published in the name of the defendant.
(8) In accordance with sub-rule (7), the tribunal shall charge the expenses incurred in meeting the deadline from the relevant party as well as the government dues.
