(1) In relation to the environmental study report submitted in accordance with Rule 8, the relevant body shall carry out necessary investigations.
(2) In order to examine the environmental study report as per sub-rule (1), the concerned body may constitute a committee as per sub-section (2) of section 7 of the Act.
(3) The committee formed in accordance with sub-rule (2) may collect the necessary data and make suggestions by conducting on-site inspection, observation and monitoring of the area where the proposal is to be implemented.
(4) The related agency may seek necessary opinions and suggestions from other government agencies concerned regarding the environmental study report.
(5) If it is found that further environmental studies should be conducted in accordance with Rule 8 of the environmental study report, the relevant body shall order the proponent to conduct a preliminary environmental test in the case of a brief environmental study and an environmental impact assessment in the case of a preliminary environmental test in accordance with section 7 of the Act. will have to give
(6). Notwithstanding anything written elsewhere in this rule, in the case of the environmental impact assessment report received in accordance with rule D, the relevant agency shall set a period of seven days for collecting opinions and suggestions by publishing a notice in any national level daily newspaper and such report may be downloaded through the relevant agency's website. It should be made public.
(7) According to sub-rule (6), any person or organization may send their opinion or suggestions to the relevant body within such period.
(8) After completing the procedure mentioned in this rule and considering the environmental study report based on the opinions and suggestions, if such proposal does not appear to have a significant adverse effect on the environment, the relevant body shall approve such environmental study report within the following period:-
(a) Brief Environmental Study or Preliminary Environmental Test within fifteen days,
(b) Environmental impact assessment within thirty five days.
(9) For the purposes of sub-rule (8), the days shall be counted from the date on which a written document has been sent to clarify a matter or additional documents have been requested.
(10) Before approving the environmental study report related to any management plan, action plan or detailed project report, such plan or project shall be approved.
