Rule 8
Aircraft registration
:
(1) If an airline operator, which has received a permit and certificate to operate air services in accordance with Rule 4, wants to register an aircraft purchased and brought or leased in the Kingdom of Nepal for commercial purposes, it must disclose the necessary details in the format mentioned in the annex and manual and attach the fee mentioned in schedule-1. The application should be submitted to the Director General.
(2) If a person or an organization wants to register an aircraft for private purposes other than commercial purposes, that person or organization should submit the application to the Director General by submitting the required details in the format mentioned in the Annex and Manual and attaching the fees mentioned in Schedule-1.
(3) According to sub-rules (1) and (2), if an application for aircraft registration is received, the Director General shall carry out necessary checks on such application, the existing laws related to non-military aviation, the provision mentioned in this regulation, annex and manual, and the air service operation provided to the relevant air service operating organization. An order to register the aircraft shall be issued subject to the conditions mentioned in the permit and certificate. The aircraft shall be used only for the purpose for which it is registered.
(4) In case of a decision to register an aircraft according to sub-rule (3), the Director General shall register the aircraft in the aircraft registration book established in the format mentioned in the Annex and Manual and give the certificate of aircraft registration to the applicant in the format mentioned in the Annex and Manual.
(5) An aircraft registered as per sub-rule (4) shall be considered as a Nepalese aircraft (6) The ownership of the aircraft shall belong to the owner of the aircraft.
(7) Notwithstanding anything written in this rule, no aircraft shall be registered until the amount to be paid to the Government of Nepal and the Authority has been paid. In addition, if the organization that has received the permission and certificate to operate the air service does not pay the amount to be paid to the Government of Nepal and the authority, the new aircraft of the said organization will not be registered and the registration of the already registered aircraft will be cancelled.
