Rule 105
Departmental inquiry not required
In the following cases, the officer empowered to order punishment shall not be subject to departmental inquiry regarding the following departmental punishment to an employee:-
(a) In case of general punishment as per clause (a) of section 72 of the Act.
(b) In case of departmental punishment to the employee whose escape is not found or it is impossible to establish contact due to any other reason.
(c) If an employee has to be given departmental punishment on the basis that he has been found guilty by the court in a criminal charge of moral turpitude.
