Rule 120
Departmental inquiry not to be conducted
: Notwithstanding anything contained in sub-rule (2) of rule 118, the officer empowered to order departmental punishment shall not be investigated for departmental punishment in the following cases:-
(a) In case of general punishment under clause (a) of rule 110,
(b) In case of departmental punishment to the armed police personnel whose fugitives have not been traced or it is impossible to establish contact for any other reason,
(c) If any armed police officer is to be punished by departmental punishment on the basis of being found to have committed a crime in accordance with section 27 of the Act or on the basis of being found guilty by the court in a criminal charge of moral turpitude.
