Section 18
Resolving Disputes
: (1) The Commission shall have the power to resolve disputes arising from the following matters:-
(a) Disputes relating to electricity arising between licensees,
(b) A matter where the licensee is not satisfied with any decision made or is offended by the action he has taken and claims compensation for that.
(2) In relation to the dispute or matter as per sub-section (1), the licensed person or the consumer may file a complaint before the Commission and if such complaint is received, the Commission shall hear and make a decision within ninety days.
(3) While processing and disposing of the complaints filed before the Commission, the Commission shall have the right to perform the following actions as per the prevailing law:-
(a) to present any person before the Commission and take statements or information,
(b) Understanding the witness,
(c) To order the submission of any written document in the Government of Nepal, the State Government or any agency or public institution at the local level,
(d) To conduct on-site inspection, to order and to submit ten evidence.
(4) A person who is not satisfied with the decision made by the Commission as per sub-section (2) may appeal to the High Court, Patan within thirty five days from the date of such decision.
(5) Notwithstanding anything written in sub-section (1), if there is a separate provision for dispute resolution in the agreement between the licensed persons regarding electricity generation, transmission, distribution or trade, such dispute shall be resolved in accordance with the said agreement.
