Rule 58
Duties, Duties and Rights of Armed Police Officers Deployed in Special Tasks
: (1) If an armed police officer is found to be involved in criminal activities in accordance with Section 6 of the Act, he/she shall take control of the person involved in such activities or the goods related to such activities or prevent the commission of a crime. Or it shall be the duty of such armed police officer to provide security to persons, organizations, buildings, places, structures or works.
(2) In the case of a person who has been detained in accordance with sub-rule (1), in accordance with rule 163 and in the case of goods, the list shall be handed over to the local police or other related crime investigation agency or authority as soon as possible.
(3) If any person commits an act of coercion, assault with or without arms, or makes an armed police officer unable to perform his duty or attempts to perform such an act in order to prevent the armed police officer from fulfilling his duties, the armed police officer so assigned shall If it is not possible to fulfill the prescribed duty without immediate use of final force to protect or defend life or the person or place he is supposed to protect, he may use final force.
(4) According to sub-rule (3), if a person dies or is injured while acting with good intentions or using force in the performance of duty, no case can be prosecuted against such armed police personnel without the approval of the Government of Nepal.
