Rule 65
Can open a school to give special education

(1) If any institution wishes, it may open a school to impart special education in accordance with this regulation.
(2) At the time of commencement of this regulation, if the institution which is conducting special education by receiving subsidy from Nepal Government opens a community school according to sub-rule (1), the Ministry may approve the necessary teacher posts for such school.
(2a) When arranging teachers according to sub-rule (2), when such school conducts special education as an institution before the commencement of this sub-rule, the number of teachers can be arranged only in such a way that the number of teachers who have received subsidy for teacher salary from the Government of Nepal or Special Education Council does not increase.
(3) According to sub-rule (2), the Commission shall recommend the person who is permanently employed as a teacher in such a school at the time of commencement of this regulation, subject to the age at which he/she can hold the position of teacher, for appointment to the position of teacher in accordance with the prevailing law. There will be no limit.
(4) According to sub-rule (3), the person recommended by the commission will be appointed as a teacher by the district education officer.
(5) The service period of the teacher appointed as per sub-rule (4) shall be calculated from the date of permanent placement in the special education institution as per sub-rule (2).
(6) The services, conditions and facilities of teachers and staff working in public schools conducting special education in accordance with this rule shall be the same as teachers and staff of other public schools.
(7) Teachers appointed in accordance with this rule shall not be transferred to any other school except the school providing special education.
