Section 105
Establishment of Management Committee
: (1) In case any organization or association is declared as a troubled organization or association in accordance with this Act, the Government of Nepal shall constitute a Management Committee to perform the work related to the asset management and payment of liabilities of such troubled organization or association.
(2) The management committee as per sub-section (1) shall have the following chairman and members:-
(a) A person appointed by the Government of Nepal from among the persons who have worked in a special category of the Nepal Justice Service who has become a judge of the High Court or has worked in a similar position - Chairman
(b) One person nominated by the Government of Nepal from among the persons who have worked at least in the gazetted first class or an equivalent position in the civil service. (c) One managing representative appointed by the National Co-operative Federation - Member (d) Two members nominated by the Government of Nepal from among experts in the cooperative sector (e) One person nominated by the Government of Nepal from among the persons who have worked for at least three years in the supervisory field of banks and financial institutions in a position of at least ninth level or equivalent or as a chartered accountant - Member
(f) Gazetted Second Class Officer designated by the Government of Nepal - Member - Secretary (3) The term of office of the chairman and members of the management committee shall be a maximum of two years from the date of appointment and the Government of Nepal may extend their term of office for a maximum of two years as per the need.
(4) Notwithstanding anything written in sub-section (3), if the performance of the chairman or member of the management committee is not satisfactory, the Government of Nepal may remove him/her from the position at any time.
(5) According to sub-section (4), before the chairman or member of the management committee is removed from his position, he should be given a reasonable opportunity to submit an explanation.
(6) According to sub-section (4), the Government of Nepal shall fill any position of the management committee that has become vacant subject to sub-section (2).
(7) The procedure for the meeting of the management committee shall be as determined by the committee itself.
(2) The management committee as per sub-section (1) shall have the following chairman and members:-
