Section 19
Appointment of Secretary
(1) Regardless of what is written in the current law, an employee working at the twelfth level of the health service and having worked at least five years at the eleventh level may be appointed to the position of secretary of the Ministry of Health and Population based on seniority and performance evaluation.
(1a) According to sub-section (1), in order to be appointed to the post of secretary, one must have passed the high-level management training prescribed by the Government of Nepal.
(1B) The appointment of the Secretary will be made by the Government of Nepal on the recommendation of the promotion committee as follows:-
(a) Chairman of the Public Service Commission or a member of the commission appointed by him - Chairman
(b) Members of the Public Service Commission designated by the Chairman of the Commission – Member
(c) Chief Secretary – Member (d) Expert in the concerned subject nominated by the Public Service Commission – Member
(e) Secretary to the Ministry of General Administration – Member – Secretary
(2) The term of office of the secretary appointed under sub-section (1) shall be five years subject to section 45.
(3) According to sub-section (2), while calculating the term of office of the secretary, his service period at the twelfth level shall also be counted.
