Section 43
Punishment

(1) If someone is found to be operating an industry without registering the industry in accordance with section 3, the Ministry, on the recommendation of the industry registration body, may order the immediate closure of such industry and impose the following fines:-
(a) Five thousand rupees in case of small enterprises,
(B) _ Twenty five thousand rupees in case of domestic and small industries,
(c) In case of medium industries, fifty thousand rupees,
(d) One lakh rupees in the case of major withdrawals.
(2) If an industry acts contrary to its purpose, the Ministry may, on the recommendation of the industry registration body, fine such industry as follows:-
(a) Fine up to two thousand rupees in case of small enterprises,
(b) In the case of domestic and small industries, to impose a fine of up to fifty thousand rupees,
(c) Fine up to one lakh rupees in case of medium level industry,
(d) If there is a large-scale industry, fine up to five lakh rupees.
(3) If an industry fails to provide information on the commencement of business operations or commercial production or business within the period specified in Section 9, the Ministry shall, on the recommendation of the industry registration body, impose the following fines:-
(a) Two thousand rupees for every six months in case of Lagu Ucham,
(b) Ten thousand rupees for every six months in case of household and small industries (c) Twenty five thousand rupees for every six months in case of medium and large scale.
(4) If an industry relocates the industry without obtaining approval in accordance with Section 11 or increases capital, increases capacity, increases or changes objectives without obtaining approval in accordance with Section 12, the Ministry may impose any of the following fines on the recommendation of the industry registration body:-
(a) Five thousand rupees in case of small enterprises,
(b) In case of domestic and small scale industries from twenty five thousand to fifty thousand rupees,
(c) In case of medium and large scale industries from one lakh to three lakh rupees,
(d) 100% additional fine to the fine imposed as per clause (b) or (c) in case of industries requiring permission as per clause d.
(5) For any purpose, the details specified in accordance with section 13If it is not provided within the deadline, the agency registering the industry may fine such industry as follows:-
(a) - Minimum one thousand rupees,
(B) Five thousand rupees to domestic and small industries (c) Ten thousand rupees for middle class,
(d) Twenty five thousand rupees to large industries.
(6) If an industry does any act contrary to section 36, on the recommendation of the industry registration body, the ministry may stop any incentive, discount, facility or concession provided to such industry at any time, collect an amount equal to such incentive, discount, facility or concession or its equivalent. The amount can be fined.
(7) If an enterprise does not carry out the professional social responsibility according to section 54, the ministry may impose a fine amounting to 1.5% of the annual net profit of such industry on the recommendation of the industry registration body. The industry that does not carry out such responsibility for more than one financial year will be fined at the rate of 0.5% of the annual net profit per year.
(8) If an industry fails to comply with the conditions to be followed in accordance with this Act or the regulations made under this Act or the instructions given by the Ministry from time to time on the recommendation of the registration body, the industry registration body may fine such industry as follows:-
(a) Up to five thousand rupees in the case of Lagu Ucham,
(b) In the case of domestic and small industries from fifty thousand to one hundred and fifty thousand rupees,
(c) in the case of medium industries from one lakh fifty thousand to three lakh rupees,
(d) In case of large industries, from two lakh fifty thousand to three lakh rupees.
(9) Apart from what is written in this section, the Ministry may, on the recommendation of the industry registration body, impose the following fines on any industry that violates this Act or the rules made under this Act:-
(a) Up to fifteen thousand rupees in case of small enterprises,
(b) From fifteen thousand to thirty thousand rupees in case of domestic and small industries (c) in the case of medium industries from thirty thousand to fifty thousand rupees,
(d) Large industriesFrom fifty thousand to one lakh rupees.
(10) In the case of any use for which permission is required under Section 8 while imposing the fine under this section, an additional penalty of fifty percent of the fine imposed under this section will be imposed.
(11) Regardless of what is written in this section, the provisions regarding fines and action against industries registered and regulated by the provincial and local levels shall be as determined by the respective provincial or local laws.
