3. Formation of Committee: (1) There will be a committee named Human Organ Transplantation Development Committee to carry out work related to human organ transplantation.
(2) The constitution of the committee as per sub-section (1) shall be as follows:-

(a) Employees of the specific category of health service prescribed by the Government of Nepal - Chairman
(b) Eleventh level employee (physician) of the health service designated by the Ministry - Member
(c) Two members from amongst the medical practitioners concerned with human organ transplantation (d) one member from among the organizations concerned with human organ transplantation (e) One of the persons who donate and receive human organs – Member
(f) Executive Director-Member-Secretary

(3) The Ministry shall nominate the members as per clauses (c), (d) and (e) of sub-section (2).
(4) The term of office of nominated members shall be four years (5) Notwithstanding anything contained in sub-section (4), if any nominated member does not act in accordance with his position, the Ministry may remove him at any time.
(6) Before removing a member as per subsection (5), he will be given an opportunity to submit his explanation.
