Section 26
No use of personal information without consent
(1) Personal information collected by a public body or organization or under the charge or control of such body or organization shall not be used or given to anyone without the consent of the person concerned except in the following cases:-
(a) For the purpose for which the personal information was collected is made public or distributed,
(b) In connection with the investigation or prosecution of a criminal case, on demand in writing from the authority authorized to conduct such investigation or prosecution,
(c) on the order of the court in connection with the proceedings of the case pending in the court,
(d) If a question arises regarding the qualification of a person holding a public office or any other matter in accordance with the prevailing law, (e) When a specific issue arises and a specific request is made in writing by an authority entitled to information to resolve the same.
(2) Notwithstanding anything contained in sub-section (1), the authorized officer of the agency responsible for collecting or protecting personal information may disclose or cause to be made public any personal information for the purpose of a study or investigation carried out for public purposes in the following cases:-
(a) If the subject which is investigated cannot be completed without personal identification,
(b) If the personal information of the subject is given for the purpose of investigation, if the giving of such information does not cause any harm to the concerned person,
(c) If the person concerned has given consent at the time of receiving personal information for public purposes or at any time thereafter.
(3) Notwithstanding anything contained in this section, personal information may be provided for the purposes of archives officially established by the Government of Nepal or the State Government in the following cases:-
(a) If there is any information that does not adversely affect the personal status, professional or personal privacy of the person concerned,
(b) such information for historical research or collection or collection of historical facts or informationIf provided,
(c) In the case of personal information of a person, if thirty years or more have passed since the death of such person, but the disclosure of such person's personal information would be insulting to him or his rights or children would be harmed, damaged or insulted in any way, providing such information Can't be done.
(d) If such information has been recorded for a period of one hundred years or more.
