Section 3
Being entitled to information
(1) Every Nepalese citizen shall have the right to information subject to this Act.
(2) Every Nepali citizen will have access to the information in public bodies.
(3) Notwithstanding anything contained in sub-sections (1) and (2), information relating to the following matters in a public body shall not be conveyed:-
(a) causing serious disturbance to Nepal's sovereignty, integrity, national security, public peace and order or international relations,
(b) Directly affecting the investigation, investigation and prosecution of crimes,
(c) economic, commercial and monetary interests or protection of intellectual property or serious prejudice to banking or business confidentiality,
(d) Directly disrupting good relations between different castes or sects,
(e) pose a threat to personal privacy or the life, property, health, or safety of any person. However, the public body will not be able to avoid the responsibility of providing such information unless there is a reasonable and sufficient reason for not providing such information.
(4) If there is information in the records of the public body that can and cannot be transmitted according to this Act, the Information Officer shall separate the information that can be transmitted and provide it to the applicant.
