Section 26
Acquiring unregistered land after taking approval
- (1) To acquire unregistered land, approval must be obtained from the designated committee.
(2) An application must be submitted to the designated committee for approval to acquire unregistered land.
(3) Only a person who does not have his own land to the extent prescribed by the status of Mohi or Jagwala will be allowed to submit an application as per sub-section (2).
(4) The designated committee may give permission to the person as per sub-section (3) to acquire unregistered land subject to this Act and the rules made under this Act and other applicable laws of Nepal.
(5) When the committee designated as per sub-section (4) gives approval, the terms and conditions for the right to usurp such land shall be as prescribed. But,
(a) Nothing written in this section shall have the right to grant approval for land acquisition or land acquisition which should not be registered in accordance with sub-section (1) of Article 24.
(b) For any reason, the land that cannot be registered in the name of any person, the committee assigned to that person will not approve the land to be claimed.
(c) If more than one person applies for permission to use the same land, permission will be given according to the priority as specified.
(6) Regardless of what is written in this section, if the land of any area is settled, the government of Nepal may sell and distribute the land according to the prevailing Nepal law regarding land rehabilitation to the extent specified.
(7) When the designated committee approves land acquisition or distributes land for the purpose of residence in accordance with sub-section (6), the designated committee or the relevant officer shall cause such land to be registered.
(8) The decision or order made by the concerned committee or officer under this section shall be implemented by the office of the customs office as prescribed.
(2) An application must be submitted to the designated committee for approval to acquire unregistered land.
(3) Only a person who does not have his own land to the extent prescribed by the status of Mohi or Jagwala will be allowed to submit an application as per sub-section (2).
(4) The designated committee may give permission to the person as per sub-section (3) to acquire unregistered land subject to this Act and the rules made under this Act and other applicable laws of Nepal.
