: (1) When determining the punishment for an offender who commits more than one offense in the same incident, each offense shall be considered separate and therefore the punishment shall be determined separately. 7 Amended by Act, 2075 to amend some Nepal Acts related to the Civil Code. 18 Removed by the Act to amend some Nepal Acts related to the Civil Code, 2075. 2) If an offense is committed by two or more acts and any one of such acts is a separate offense by itself, only the offense that carries the highest punishment shall be punished.
(3) If there are separate offenses under different Acts for any one act, the punishment according to the Act under which the punishment is higher will be executed. But while determining the punishment, separate punishment should be prescribed for each crime. Explanation For the purpose of this section, imprisonment and fine shall be treated as separate punishments and shall be executed separately.
