Section 35
Fines

(1) If someone commits or causes the following acts, the concerned body shall impose a fine as follows:-
(a) In the case of a proposal requiring the approval of a brief environmental study report, if such report is not approved or if any proposal is implemented contrary to the approved report, up to five lakh rupees,
(b) up to ten lakh rupees if any proposal is implemented without accepting the preliminary environmental test report or contrary to the approved report,
(c) In the case of a proposal requiring the approval of an environmental impact assessment report, up to fifty million rupees if the report is not approved or if any proposal is implemented contrary to the approved report.
(2) If someone commits an act as per sub-section (1), the relevant body shall stop such act immediately and if the environmental study report is not approved, it shall order such report to be approved in accordance with this Act and if there is an act contrary to such report, to correct the said act and to do so according to the order given, the concerned person or The organization will have a duty. If the action is not done according to the order given in this way, the relevant body will impose a fine of three times the fine imposed as per sub-section (1).
(3) Apart from the matter mentioned in sub-section (1), if anyone does any act contrary to this Act or the rules, guidelines, procedures or standards made under this Act, the relevant body shall impose a ban on such act and impose a fine of up to three lakh rupees within two months in accordance with this Act and this Act. (4) If the action is not in accordance with the order given under sub-section (2) or (3), such action shall be banned and such person or organization shall be blacklisted and the relevant body shall send it to the department with a recommendation to take necessary action.
(5) If a recommendation is made in accordance with sub-section (4), such person or organization, if the department finds it necessary to carry out the necessary investigation,He should be blacklisted for one to five years.
