Section 2
Definition
In this Act, unless the subject or the context otherwise requires,-
(a) "Constitution" means the Constitution of Nepal.
(b) "Commission" means the Commission for Investigating Abuse of Authority constituted under Article 238 of the Constitution.
(c) "Commissioner" also means the Chief Commissioner of the Commission.
(d) "Person holding a public position" shall mean a person holding a position who has the right to exercise any public authority or is required to perform any duty or discharge an obligation in accordance with the Constitution, other prevailing laws or the decision or order of the relevant body or official, and The term also refers to an official or employee in a position of a public institution.
(e) "Public Institution" means the following institutions:-
(1) Companies, banks or committees wholly or partially owned or controlled by the Government of Nepal or commissions, institutes, authorities, corporations, foundations, boards, centers, councils and other organized organizations of a similar nature established by the Government of Nepal in accordance with prevailing laws. (2) Universities, colleges, schools, research centers and other similar academic or educational institutions run by the Government of Nepal or fully or partially subsidized by the Government of Nepal,
(3) The local level formed according to the Local Autonomous Government Act, 2055,
(4) Institutions running on loans, grants or guarantees from the Government of Nepal,
(5) An entity wholly or partially owned or controlled by an entity referred to in subsection (1), (2), (3) or (4),
(6) Any other organization designated as a public organization by the Government of Nepal by publishing a notice in the Nepal Gazette.
(f) "Investigating officer" means a person appointed under this Act to investigate and investigate abuse of authority.
(g) "Improper act" means any act done by a person holding a public office as mentioned in Section 3.
(h) "Corruption" means an offense punishable according to the prevailing law on prevention of corruption.
(i) "abuse of authority" means an act under clause (g) or (h);It should be considered fraud or corruption.
(j) "Court" means the court as per sub-section (1) of section 34.
(k) "Authority" shall mean the authority provided in the existing law or contract or any similar document regarding the conditions of service of a person holding a public office and the term also refers to the authority authorized to appoint, retire or supervise the work of such a person.
