Section 2
Definition

In this Act, unless the subject or context otherwise requires,–
(a) "Breast milk substitute product" means a food product sold and distributed to replace breast milk partially or completely.

(b) "Container" means a product sold as a retail unit. Any kind of "poca (package)" used for this should be considered, and the word also refers to wrapping items (wrappers).
(c) "Committee" means Breastfeeding Protection and Promotion Committee constituted under Section 4.
(d) "Product" means any of the following items:-
(1) A substitute for mother's milk,
(2) any kind of milk sold and distributed to be suitable for use in infant feeding, with or without alteration,
(3) Any other food or beverage sold and distributed as suitable for feeding a child,
(4) Dudhdani and Munto.
(e) "Distributor" means a person involved in the sale and distribution of a product, wholesale or retail, and the term also refers to a person involved in providing public relations services or information related to a product.
(f) "Health care agency" means any government, non-government or private institution or organization or person directly or indirectly involved in health care and the term also refers to nurseries (children's homes) and other child care institutions.
(g) "Health practitioner" means a doctor, registered nurse or nutritionist or other such persons as specified by the Government of Nepal by publishing a notice in the Nepal Gazette.
(h) "Health worker" means a person working in a health care agency or receiving training to work and engaged in health care work whether or not remunerated.
(i) "Child" means an infant up to the age of twelve months.It should be considered as a substitute for mother's milk prepared according to the prevailing Nepali quality to suit the country and the physical structure of such children.
(k) "Level" means any tag, mark, picture or other descriptive item written, printed, litho, marked, embossed, incorporated or otherwise displayed on the container containing the product.
(l) "Manufacturer" means a person engaged in the business of manufacturing or manufacturing, either directly or through an agent or by contract or through a person controlled under the contract.
(D) "Sales Distribution" means any act of bringing or selling such products to the market, including promotion, distribution, advertising, sample distribution, public relations and information services.
(l) "Sample" means one or a small quantity of the Product supplied free of charge.
(n) "Complementary food" means suitable food to be used as a supplement when mother's milk or a substitute for mother's milk is insufficient to meet the nutritional needs of the child.
(s) "Ministry" means Government of Nepal, Ministry of Health and Population.
(h) "Prescribed" or "as prescribed" shall mean as prescribed or prescribed in the rules made under this Act.

Unless the subject or context requires otherwise, in this Act,-

(e) "Distributor" means a person involved in the sale and distribution of a product, wholesale or retail, and the term also refers to a person involved in providing public relations services or information related to a product.
(f) "Health care agency" means any government, non-government or private institution or organization or person directly or indirectly involved in health care and the term also refers to nurseries (children's homes) and other child care institutions.
(g) "Health practitioner" means a doctor, registered nurse or nutritionist or other such persons as specified by the Government of Nepal by publishing a notice in the Nepal Gazette.

(j) "Balsutra" means a popular Nepali diet for the purpose of meeting the general nutritional needs of children between the ages of four to six months and to suit the physical structure of such children. It should be considered as a substitute for mother's milk prepared according to the quality.
(k) "Level" means any tag, mark, picture or other descriptive item written, printed, litho, marked, embossed, incorporated or otherwise displayed on the container containing the product.
(l) "Manufacturer" means a person engaged in the business of manufacturing or manufacturing, either directly or through an agent or by contract or through a person controlled under the contract.
(d) "Sales distribution" means product promotion, distribution, advertisement, sample distribution, public relations and information services including bringing such product to the market.or any act of selling should be remembered.
(l) "Sample" means one or a small quantity of the Product supplied free of charge.
(n) "Complementary food" means suitable food to be used as a supplement when mother's milk or a substitute for mother's milk is insufficient to meet the nutritional needs of the child.
(s) "Ministry" means Government of Nepal, Ministry of Health.
(h) "Prescribed" or "as prescribed" means prescribed or prescribed in the rules made under this Act.
