Section 72
Punishment
(1) If any person, institution or agency violates the rights of children mentioned in paragraph-2 or does not fulfill the obligations towards children mentioned in paragraph-3, such person or head of organization or agency shall be fined up to fifty thousand rupees.
(2) If the guardian or any member of the family fails to fulfill his obligations or if the mother, father or guardian changes the name, surname in such a way as to hide the identity of the child with the intention of taking unfair advantage, or if the child's property is misused, such mother, father or family member or guardian shall be fined up to one lakh rupees.
(3) If someone commits an offense against children, he shall be punished as follows according to the amount of the offence:-
(a) clauses (a), (b), (c), (d), (e), (f) or (d) of sub-section (2) of section 66 or sub-section (1) or (2) of section 78 ) shall be fined up to fifty thousand rupees and imprisoned up to one year,
(b) clause (g), (j), (t), (l), (d), (n) or (th) of sub-section (2) of section 66 or clause (a) of sub-section (3), (b), (c), (e), (f) or (j) shall be fined up to seventy-five thousand rupees and imprisoned for up to three years, (c) If he commits an act under clause (d) of sub-section (3) of section 66, a fine up to eighty thousand rupees and imprisonment up to four years,
(d) Fine up to one lakh rupees and imprisonment up to five years if he commits any act under clause (h) or (j) of sub-section (2) of section 66,
(e) If he commits an act as per Clause (d) of Sub-section (2) of Section 66, half of the punishment of the offender for such offense for which he has been taught or trained,
(f) A fine up to five lakh rupees and imprisonment up to ten years, if he commits an act under clause (t) of sub-section (2) of section 66,
(g) If any act is committed under clause (g) or (h) of sub-section (3) of section 66, the punishment for the offense of coercion shall be imposed on the offender as per the prevailing law.
(h) A fine up to one hundred and fifty thousand rupees and imprisonment up to fifteen years if he commits any act under clause (j) or (t) of sub-section (3) of section 66.
(4) Any person who incites, indulges in or indulges in the acts mentioned in sub-sections (1), (2) and (3) shall beThis offender shall be punished with half of the fine and imprisonment.
(5) If any person commits any other act contrary to this Act or the rules made under this Act, except as provided in this section, such person shall be punished with a fine of up to fifty thousand rupees or imprisonment for a term of one year or both, depending on the amount of the offence.
(6) If a person who has been punished once under this Act commits the same act again, he will be punished twenty five percent more than the punishment according to this section.
(7) Notwithstanding anything written elsewhere in this section, if the act as per sub-section (3) is considered an offense under any other prevailing law, then the provisions of this section shall not prevent such offense from being prosecuted separately in accordance with that law, and no one shall do any act contrary to this Act. According to the prevailing law, if he is punished more than what is written in this section, he will be punished accordingly.
(8) If anyone establishes or operates a children's home, child correctional home, monitoring room, rehabilitation center or temporary protection service center without obtaining approval in accordance with this Act, the Ministry shall close such children's home, child correctional home, monitoring room, rehabilitation center or temporary protection service center. The person and organization involved may be fined up to one lakh rupees and may take other actions according to the prevailing law.
