Section 21
Punishment
(1) A person who commits the following offense will be punished as follows:-
(a) According to Clause (a) of Section 20, the person who commits an offense related to rare wildlife or its specimen shall be imprisoned for five years to fifteen years depending on the amount of the offense or a fine of five lakh to ten lakh rupees or both and the person who commits an offense related to rare plant or its specimen shall be liable to imprisonment for a term of five to fifteen years depending on the amount of the offense. Imprisonment from one year to five years or fine from one lakh rupees to five lakh rupees or both.
(b) According to Clause (a) of Section 20, the person who commits an offense related to endangered wildlife or its specimen shall be imprisoned for two years to ten years depending on the amount of the offense or a fine of Rs. Or a fine ranging from fifty thousand rupees to one lakh rupees or both.
(c) According to clause (b) of Section 20, those who commit offenses related to protected wild animals or their specimens shall be imprisoned for one to five years or fined from two thousand rupees to one lakh rupees or both and those who commit offenses related to protected plants or their specimens shall be liable to one month to six months depending on the amount of the offence. Imprisonment or fine from one thousand rupees to fifty thousand rupees or both.
(d) Those who act contrary to clauses (c) and (d) of section 20 shall be fined from fifty thousand rupees to one lakh rupees according to the amount of the offence.
(e) Any person who commits an act under Clause (e) of Section 20 shall be fined from one thousand rupees to twenty five thousand rupees according to the amount of the offence.
(f) A person who helps, abets, incites or engages in the commission of any offense under this Act shall be punished with half of the punishment for the principal offender.
(2) An accomplice who helps or provides assistance in any way to a person who commits an offense under this Act shall be sentenced to half of the punishment imposed on the principal offender.
(3) A person who obstructs the investigation of an offense under this Act shall be punished with imprisonment for a term which may extend to three months or with a fine which may extend to five thousand rupees or with both.
