Section 29
Procedure to be followed while redirecting
(1) One or more of the following suitable procedures will be adopted while considering the wishes of the children while diverting:-
(a) Reconciliation or settlement with the child victim,
(b) making children feel guilty,
(c) To provide necessary counseling to the child and his family,
(d) Refer children to any community service,
(e) sending the child to an institution for care and protection,
(f) to leave children under the supervision and direction of a child welfare officer,
(g) entrusting children to their father, mother, other family members or guardians,
(h) involving children in any training or educational program.
(2) In the case of diversion following any procedure as per clauses (d), (e), (f), (g) and (h) of sub-section (1), the period shall also be specified.
(3) In case of diversion following the procedure as per clauses (d), (e) and (f) of sub-section (1), diversion shall not be carried out in a manner that exceeds the maximum punishment that can be imposed on children for committing criminal acts.
(4) Before the investigation officer or the public prosecutor directs the children, they should get a report from a child psychologist and a child expert on the physical and mental condition of the child and from a social worker to study and analyze the economic, cultural condition and environment of the child.
(5) In accordance with sub-section (1), the investigating officer, public prosecutor or the juvenile court shall give the information about the referral of the children to their higher authority and the juvenile court.
(6) If the children accused of delinquent acts are diverted, such dispute shall end and the formal judicial process shall be deemed to have ended.
(7) The investigating officer, the public prosecutor or the juvenile court should make arrangements to monitor whether the children who have been referred have participated in the referral process continuously through the probation officer.
(8) To childrenDue to the loss caused to the victim during diversion, the following can be done:-
(a) compensating the victim or making good the actual loss,
(b) to order the return of the property, profits or materials derived from the criminal act to the person concerned.
(9) Other arrangements related to diversion shall be as prescribed.
