Section 48
Children with Special Protection Needs

(1) The following children will be considered as children in need of special protection:-
(a) Orphan children,
(b) Children left or found stranded in a hospital or any other public place, separated from their parents or orphaned without their parents being found,
(c)   Children not receiving proper care because of severe physical or mental disability or infirmity of the parents,
(d)   Children who are recommended for alternative care under the diversion process among children in legal dispute,
(e) Children who are in custody or who are dependent on their father or mother in prison,
(f)   A child who has made an application to the Child Welfare Officer stating that he is unable to support a child born of coercion or a coercion punishable by law,
(g)   Children who have been separated from their families in the best interests of the child because of abuse, violence or neglect by their father, mother or guardian,
(h) engaged in labor of a forced or servile nature or of a hazardous or degrading nature or contrary to prevailing laws, addicted to smoking, drinking and other drugs, HIV Infected children,
(i) Children whose lives are at risk due to serious physical or mental health problems or serious disabilities and whose parents or family cannot provide treatment or who have difficulties in leading a normal life,
(j) Children who are victims of or are at risk of crimes against children,
(k)   Children who have lost both or one of their parents due to disaster or armed conflict, have gone missing or have themselves been physically or mentally injured or disabled,
(l) Children of poor Dalit community,
(d) Other children designated as children in need of special protection by the Ministry by publishing a notice in the Nepal Gazette.
(2) Rescue, temporary protection, health treatment, psycho-social support, family reunification, rehabilitation, alternative care, family support, social security, socialization and other services and support will be provided to the children as per the requirements of sub-section (1).
