(1) The Abuse of Authority Investigation Commission may investigate or conduct an investigation in accordance with the law regarding abuse of authority by a person holding a public office. However, this clause shall not be applicable in the case of officials with separate provisions in this constitution and officials with separate special provisions in other laws.
(2) In the case of a person dismissed from office after the impeachment motion is passed in accordance with Article 101, a judge dismissed from office by the Judicial Council, and a person who is prosecuted under the Military Act, an investigation may be conducted or conducted in accordance with the federal law after the person is dismissed from office.
(3) If any person holding a public position is found to have committed any act considered corruption according to the law from the investigation according to sub-section (1) or (2), the Commission for Investigation of Abuse of Authority shall file a case against such person and other persons involved in such crime in the court authorized according to law or Will be able to do. (4) If it appears from the investigation conducted according to sub-section (1) or (2) that the actions of a person holding a public position fall under the jurisdiction of another authority or body, the Commission for Investigation of Abuse of Authority may send a written notice to the relevant authority or body for necessary action.
(5) The Abuse of Authority Investigation Commission may delegate any of its work, duties and powers of investigating or prosecuting cases to the Chief Commissioner, any commissioner or an authorized employee of the Government of Nepal subject to the prescribed conditions.
(6) Other work, duties and rights and procedures of the Abuse of Authority Investigation Commission shall be in accordance with the federal law.
