Article 101
Impeachment

(1) On the basis of serious violation of this Constitution and laws, one-fourth of the total number of members in the House of Representatives may submit a resolution of impeachment against the President or the Vice-President. If such proposal is passed by a majority of at least two-thirds of the total number of members of both houses of the Federal Parliament, he will be relieved of his post.
(2) One-fourth of the total number of members in the House of Representatives immediately on the basis of serious violation of this constitution and laws, lack of efficiency or bad conduct or not faithfully fulfilling their official duties or serious violation of the code of conduct A motion of impeachment may be submitted against the Chief Justice or the Supreme Court judge, the member of the Judicial Council, the head of the constitutional body or the official. If such a proposal is passed by at least two-thirds of the total number of members in the House of Representatives, the concerned person will be released from office.
(3) There shall be an impeachment recommendation committee in the House of Representatives for the purpose of investigating and recommending whether there are grounds and reasons for submitting a proposal of impeachment against a person as per sub-section (2).
(4) The committee under sub-section (3) will consist of eleven members of the House of Representatives.

(6) After the commencement of impeachment proceedings as per sub-section (2), the Chief Justice of Nepal or the Supreme CourtThe judge of the court, the member of the judicial council, the head or the officer of the constitutional body will not be allowed to perform the duties of his position until such action is decided.
(7) The person accused of impeachment under sub-section (1) or (2) shall be given a reasonable opportunity to present his vindication.
(8) If the President or Vice President, Chief Justice of Nepal or Supreme Court Judge, member of the Judicial Council, head or office bearer of the constitutional body committed any offense while in office after the motion of impeachment has been passed in accordance with this article, there shall be no impediment to take action in accordance with the federal law. br> (9) A person who has been relieved of office after the motion of impeachment has been passed in accordance with sub-section (1) or (2) shall not be able to take any benefits from such office and may not be appointed or nominated to any public office in the future.
(10) Other arrangements related to impeachment shall be in accordance with the federal law.
